Special Quota Allocation Principles for 2002

2. As a special measure to assist the textiles trade to tide over the sharply negative impact of the disastrous terrorist attacks in the US on 11 September 2001, the Trade and Industry Department will on a one-off and exceptional basis, for the quota/permit allocation exercise in 2002, lower the benchmark for entitlement to quota/permit allocation equivalent to 100% of one's 2001 quota/permit holding in a category. Details of the revised rules are set out in paragraphs 3 - 4 below.

3. For the purpose of quota/permit allocation for 2002, the benchmark for an individual quota/permit holder to be entitled to receive an allocation in 2002 equal to 100% of his quota/permit holding in 2001 will be lowered from 98% to 88%. The revised principles for the allocation of quotas/permits for 2002 arising from shipment performance against 2001 quota/permit allocation are as follows:



1. a quota/permit holder which used less than 88% of its 2001 quota/permit holding in a category will be offered an allocation in 2002 equal to the amount it utilised during 2001 in the category concerned; and



2. a quota/permit holder which used 88% or more of its 2001 quota/permit holding in a category will be offered an allocation in 2002 equal to 100% of its 2001 quota/permit holding in the category concerned.

The principles of bonus allocation to temporary transferees and allocation to temporary transferors will remain unchanged.


4. Companies/registered businesses are requested to note that the special allocation arrangements in paragraph 3 above are one-off special measures implemented on an exceptional basis to help the trade tide over the current hardship caused by a sharp contraction in business which is totally unforeseen. They only apply to quota/permit allocation in 2002. The quota utilisation benchmark will be reverted to 98% for the purpose of quota/permit allocation beyond 2002. Detailed arrangements will be announced in the Notice to Exporters on Principles of Quota Allocation and Control Arrangements for 2002 in due course.

5. The Department will make available to the trade all unutilised quotas/permits after the final licensing date of 1 December 2001 as free quotas under the 2001 Year-End Special Shipment Scheme. For details of the application procedures under the Scheme, please refer to separate Notices to Exporters: Series 1 (USA) No. 50/01 and Series 2 (EU) No. 31/01 dated 23 November 2001, and Series 3 (Countries other than USA & EU) No. 34/01 dated 22 November 2001.

2002年 特 別 配 額 分 配 原 則

2. 於 2001年 9月 11日 在 美 國 發 生 的 災 難 性 恐 怖 襲 擊 事 件 對 紡 織 業 有 急 劇 的 負 面 影 響 ， 為 協 助 紡 織 業 界 渡 過 困 境 ， 本 署 將 採 取 特 別 措 施 ， 在 進 行 2002年 配 額 /許 可 證 分 配 時 ， 破 例 降 低 配 額 /許 可 證 持 有 人 需 要 達 到 的 使 用 率 標 準 ， 而 仍 可 獲 分 發 相 等 十 足 其 在 2001年 的 配 額 /許 可 證 持 有 量 。 這 次 安 排 只 屬 一 次 過 特 別 性 措 施 。 下 文 第 3及 4段 載 述 經 修 訂 規 則 的 詳 情 。

3. 就 2002年 配 額 /許 可 證 分 配 而 言 ， 個 別 配 額 /許 可 證 持 有 人 獲 得 100%配 額 /許 可 證 分 配 的 配 額 使 用 率 標 準 ， 會 由 目 前 的 98%降 至 88%。 憑 2001年 所 持 配 額 /許 可 證 的 付 運 實 績 而 進 行 的 2002年 配 額 /許 可 證 分 配 原 則 修 訂 如 下 ：
   
   
1. 運 用 2001年 所 持 某 一 類 目 配 額 /許 可 證 少 於 88%的 配 額 /許 可 證 持 有 人 ， 可 獲 分 配 相 等 於 其 2001年 運 用 數 量 的 配 額 /許 可 證 ； 及
   
   
2. ii. 運 用 2001年 所 持 某 一 類 目 的 配 額 /許 可 證 達 88% 或 以 上 的 配 額 /許 可 證 持 有 人 ， 可 獲 分 配 相 等 於 其 2001年 配 額 /許 可 證 持 有 量 100%的 配 額 /許 可 證 。

分 配 獎 勵 配 額 予 暫 時 承 讓 人 和 分 配 配 額 予 暫 時 轉 讓 人 的 原 則 ， 將 維 持 不 變 。


4. 商 號 ／ 已 註 冊 業 務 請 注 意 ， 上 文 第 3段 所 載 的 特 別 分 配 措 施 是 基 於 例 外 情 況 而 實 施 的 一 次 過 特 別 措 施 ， 目 的 是 紓 緩 紡 織 品 及 成 衣 貿 易 目 前 面 對 因 預 計 不 到 的 業 務 收 縮 所 帶 來 的 困 難 。 這 些 措 施 只 適 用 於 2002年 配 額 /許 可 證 分 配 。 2002年 以 後 的 配 額 /許 可 證 分 配 的 配 額 使 用 率 標 準 將 回 復 至 98%。 詳 細 安 排 將 載 於 稍 後 發 出 有 關 2002年 配 額 分 配 原 則 及 管 制 措 施 的 致 出 口 商 (紡 織 事 務 )通 告 內 。

5. 本 署 會 把 最 後 簽 證 限 期 （ 12月 1日 ） 屆 滿 前 尚 未 經 運 用 的 配 額 /許 可 證 ， 全 數 撥 歸 2001年 年 終 特 別 付 運 方 案 ， 以 自 由 額 方 式 分 發 予 業 界 使 用 。 該 方 案 的 申 請 詳 情 ， 請 參 閱 2001年 11月 23日 所 發 出 的 致 出 口 商 （ 紡 織 事 務 ） 通 告 第 一 組 （ 美 國 ） 第 50/01號 、 第 二 組 （ 歐 洲 聯 盟 ） 第 31/01號 及 2001年 11月 22日 所 發 的 致 出 口 商 （ 紡 織 事 務 ） 通 告 第 三 組 （ 除 美 國 及 歐 洲 聯 盟 以 外 的 國 家 ） 第 34/01號 。
